Product Disclosure and Terms of Use

These terms apply to your use of wreckers.co, partsonline.au, partsonline.com.au, partsuploaded.com, and Partsnet.net ("us" or "we"), as well as any related sites we operate. Our role is purely to connect wreckers (sellers) with buyers. We are not involved in any transaction between users. Your use of these sites, including offering, selling, and buying parts, is subject to the terms in this document, our Privacy Policy, and any other rules and guidelines we publish (collectively, the "Terms").

1.1 Our Role – A Matching Service Only

We provide a platform that connects wreckers who have parts for sale with buyers who are looking for those parts. We are not a party to any transaction between a wrecker and a buyer. We do not:

• Handle payments
• Arrange shipping or delivery
• Inspect parts
• Hold inventory
• Facilitate or mediate transactions

As a result, we have no control over and, to the extent permitted by law, make no warranties regarding:

• The suitability, quality, safety, condition, or legality of any part advertised
• The accuracy or truth of any listing
• The ability of a wrecker to sell or a buyer to buy a part
• The completion of any transaction

You are solely responsible for communicating with the other party, inspecting parts, negotiating terms, and completing the transaction directly.

1.2 Placing an Ad (Listing a Part)

(a) When you list a part for sale, you must comply with our ad rules.
(b) By listing a part, you grant us a license to use, reproduce, and display your ad content (including photos and descriptions) to operate the Site and for our marketing purposes.
(c) You agree that we may transfer our rights and obligations under this agreement to a third party if needed to continue providing our services.
(d) Photos or videos attached to your listing may be hosted on third-party platforms (like YouTube). You are responsible for complying with those platforms' terms of use.

1.3 Minimum Age and Legal Rights

(a) You must be at least 18 years of age to list a part, buy a part, or submit any content on the Site.
(b) If you are a seller (wrecker), you must be the legal owner of the part or have the authority to sell it.

1.4 Usage Rules

You warrant that you will not use the Site for any unlawful or prohibited purpose. You must not:

• Use automated software to mine data from the Site
• Post any content that is illegal, offensive, misleading, defamatory, infringes on someone's rights, or is spam
• Impersonate another person
• Knowingly transmit any viruses or other harmful code
• Attempt to interfere with the proper working of the Site

1.5 Our Right to Alter or Withdraw Your Listing

We may withdraw, edit, or refuse any listing at our discretion if we believe it violates these Terms, is misleading, or is otherwise inappropriate. We will try to notify you if we do so.

1.6 Warranties and “As-Is” Sales

All parts sold through the Site are sold "as-is" and "with all faults". Unless otherwise stated by the seller (wrecker) in writing, no warranty, express or implied (including any warranty of merchantability or fitness for a particular purpose), is offered by us or the seller. It is your responsibility to inspect the part or inquire about its condition before purchasing.

1.7 Communications

We may send you service-related emails (e.g., listing confirmations, inquiries) which may not include an unsubscribe function.

1.8 Manipulation and Improper Use

You must not manipulate the price or availability of any part listed on the Site, such as by making false offers.

1.9 Fees

We will notify you of any fees for using the Site, such as for premium listings. You are responsible for paying these fees in accordance with our Fee Policy.

1.10 No Warranty (by us)

(a) We take reasonable care in compiling the Site, but the information is provided 'as is'. We do not warrant that it is complete, current, or error-free.
(b) We accept listings in good faith based on the information provided by the seller (wrecker). We do not warrant that a part is suitable for your specific vehicle. You are strongly encouraged to verify the compatibility and condition of any part directly with the wrecker before you buy it.

1.11 Our Liability to You

(a) To the extent permitted by law, we are not liable for any loss or damage you suffer from using the Site, including:

• Any dispute between you and another user regarding a transaction
• The quality, condition, or suitability of any part purchased
• Losses caused by events outside our reasonable control (e.g., internet outages)
• Losses resulting from your failure to take reasonable steps to protect yourself, such as by inspecting a part before purchase

(b) If our liability cannot be excluded, it is limited, at our option, to re-supplying the service or paying the cost of having the service re-supplied.

1.12 Your Liability to Us

You agree to indemnify us against all claims, damages, and costs arising from your breach of these Terms or your use of the Site.

1.13 Termination and Suspension

We may suspend or terminate your access to the Site if you breach these Terms, do not pay fees, or if we believe there is a risk of loss or damage to us or other users. If barred, you must not attempt to create a new account.

Your use of the Site is also subject to our other policies, including our Privacy Policy and any specific rules for listing parts.
